(3) Where the content is published on other websites, social networks, sales platforms, licensing platforms, advertising networks or media, the User is obliged to comply with the rules of the respective third party as well.
Art. 6. (1) If an applicable law, a third-party platform, a client, an institution, a contract or a professional standard requires the content to be labelled as created or modified by artificial intelligence, the User is responsible for providing such a label.
(2) The Provider may offer technical means, text warnings, notes, labels or other ways of supporting transparency, but the final responsibility for the lawful use of the content after it has been downloaded or published lies with the User.
Art. 7. (1) Content created by artificial intelligence is any image, video, sound, music, voice, text, graphic element, processed file, modified photo, modified video or other digital result that has been created, modified, supplemented, enhanced or transformed by an artificial intelligence model.
(2) Such content may be created entirely by a model or created in part on the basis of materials provided by the User.
(3) Where the User uploads their own file and requests a modification, an extension, processing, enhancement, a change of style, background removal, a change of objects, an increase of the resolution or another kind of processing, the final result may contain both elements of the original file and new elements created by artificial intelligence.
Art. 8. (1) Content created by artificial intelligence is not necessarily a real photo, a real recording, an actual event, a real statement, an authentic document or factual evidence.
(2) Even when it looks realistic, such content may be invented, transformed, inaccurate, incomplete, exaggerated, stylised or misleading if it is presented without explanation.
(3) The User has no right to present content created or modified by artificial intelligence as real if this could mislead other persons, clients, institutions, viewers, buyers, media or third parties.
Art. 9. (1) The platform may provide services for creating images from text instructions, in which the User describes the desired scene, style, objects, composition or other characteristic.
(2) The result may be an image that has not existed before but may resemble real objects, faces, places, styles or scenes.
Art. 10. (1) The platform may provide services for creating or modifying images on the basis of an uploaded image.
(2) With this type of service the model may keep part of the original image, change other parts, add new elements, remove elements, change the background, the light, the colour, the style, the proportions or other characteristics.
Art. 11. (1) The platform may provide services for creating video from text, an image or another video.
(2) Video results may contain movement, a change of scene, a change of objects, camera movement, stylised transitions, synthetic faces, synthetic environments or other elements created by artificial intelligence.
Art. 12. (1) The platform may provide services for creating, transforming or processing sound, music, speech, voice elements or other audio results.
(2) When using voices, recordings of real persons or audio samples, the User is responsible for having the necessary rights and consents.
Art. 13. (1) The platform may provide services for improving quality, increasing the resolution, removing noise, changing the size, converting the format, restoring detail or other forms of technical processing.
(2) These services do not guarantee full restoration of missing information, completely accurate detail or the absence of distortions.
Art. 14. (1) Instructions to the models are text descriptions, commands, settings, parameters, sample images, sample videos, audio files or other materials by which the User guides the model towards the desired result.
(2) The quality, accuracy and predictability of the result may depend on the clarity, completeness, consistency and permissibility of the instructions entered.
(3) The Provider does not guarantee that the model will understand the instructions in the way the User meant them.
Art. 15. (1) The User is responsible for all files they upload to the platform.
(2) The User declares that they have the right to use, upload, process and submit for processing the files they use on the platform.
(3) The User has no right to upload files that infringe the rights of others, contain personal data without grounds, contain prohibited content or do not comply with the Rules on permitted content and AI generations.
Art. 16. (1) The uploaded files may affect the result in different ways depending on the model, the quality of the file, the size, the composition, the light, the resolution, the content and the chosen settings.
(2) If the input file is of low quality, too small, blurred, dark, damaged, unsuitable or incompatible, the result may be inaccurate, incomplete, distorted or unusable.
Art. 17. (1) Artificial intelligence models work probabilistically and do not guarantee a fully predictable result.
(2) One and the same set of instructions may lead to different results on different attempts, with different models or with different settings.
(3) The User understands that the results may differ from their expectations even when the instructions are clear and detailed.
Art. 18. (1) The models may make mistakes, including but not limited to:
1. Incorrect shapes of hands, fingers, faces, eyes, teeth, limbs or body;
2. Unrealistic movement in video;
3. Distorted items or objects;
4. Incorrect shadows, reflections, lights or perspective;
5. Illegible symbols, captions, numbers or signs;
6. Incorrect depiction of familiar places, objects, clothing, brands or architecture;
7. Inaccurate following of a given style;
8. Omission of part of the instructions;
9. Addition of elements that were not requested;
10. Removal or modification of important elements;
11. Change of the identity, appearance or proportions of a face;
12. Incorrect reproduction of voice, sound or pronunciation;
13. Loss of quality during complex processing;
14. Other technical, visual, audio or semantic inaccuracies.
Art. 19. (1) The models must not be used as the only source of truth.
(2) The generated results may contain invented facts, non-existent objects, erroneous statements, inaccurate data, untrue quotations, inaccurate images or misleading suggestions.
(3) The User is obliged to check all results when using them in a context in which accuracy matters.
Art. 20. (1) Content created by artificial intelligence should not automatically be accepted as true, accurate or verified.
(2) This applies in particular to content related to health, law, finance, education, history, news, politics, public topics, scientific claims, technical instructions or safety.
Art. 21. (1) The User has no right to use the platform to create misleading evidence, false documents, fake news, invented statements, untrue claims or content that could mislead third parties as to the reality of an event, a person, a place, a document or an action.
(2) If a result could be perceived as a real recording, a real photo, a real video, a real voice, a real document or a real event, the User is obliged to use it in a way that is not misleading.
Art. 22. (1) With images and video, the models may create realistic-looking scenes that are not real.
(2) The User should not use such results as proof of a real event, the real presence of a person, an action actually performed or the real condition of an object, place or situation.
Art. 23. (1) When processing faces, the models may change features, age, expression, skin colour, hairstyle, build, pose or other characteristics.
(2) The User must take care that such changes do not harm the dignity, reputation, private life or rights of the person concerned.
Art. 24. (1) Video results may contain inconsistencies between frames, unnatural movement, changes of objects, deformations, a mismatch between sound and picture, a broken sequence or other inaccuracies.
(2) The User should review the entire video before public or commercial use.
Art. 25. (1) With audio results, the models may create a synthetic voice, music, noise, speech, a song, a sound environment or another audio result.
(2) The User has no right to use the voice of a real person without consent or a legal basis where such consent or basis is required.
Art. 26. (1) The User has no right to create audio content that misleadingly suggests that a real person has said, sung, approved or done something if this is not true.
(2) The User is responsible when using audio results in advertisements, public campaigns, political messages, news, parodies, artistic works, training materials or other public materials.
Art. 27. (1) If the platform provides text results, they may contain inaccuracies, invented facts, incomplete explanations, incorrect advice, outdated information or inappropriate wording.
(2) The User must check text results before using them, especially if they concern contracts, legal matters, medicine, finance, safety, education, technical instructions or public statements.
Art. 28. (1) Text results do not constitute professional advice unless this is expressly provided by a person with the necessary qualification.
(2) The User should not use automatically created text as a final legal, medical, financial, accounting, technical or professional opinion without additional verification.
Art. 29. (1) Where content has been created or substantially modified by artificial intelligence, the User should assess whether it must be labelled as such.
(2) Labelling is particularly important where the content:
1. Looks like a real photo, a real video or a real sound recording;
2. Depicts a real person or a public figure;
3. Concerns a public, political, health, financial, legal or news matter;
4. Could be perceived as documentary evidence;
5. Is used in advertising, a commercial campaign, training, media or public communication;
6. Is published on a platform that requires such labelling;
7. Could mislead viewers, clients, buyers or institutions.
Art. 30. (1) An appropriate label may be, for example, text such as:
1. “Created by artificial intelligence”;
2. “This image was created by artificial intelligence”;
3. “This video contains elements created by artificial intelligence”;
4. “This content is an artistic visualisation created by artificial intelligence”;
5. “This photo was modified by artificial intelligence”;
6. “This voice was created synthetically”;
7. “This content does not depict a real event”;
8. Other clear and understandable text that does not conceal the nature of the content.
Art. 31. (1) The label should be visible, understandable and placed in a context in which users, viewers or recipients can easily notice it.
(2) Placing an unclear, hidden, misleading or hard-to-notice label may not be sufficient where there is a risk of misleading anyone.
Art. 32. (1) Synthetic content imitating real persons is content that, by means of artificial intelligence, realistically reproduces or resembles the face, voice, behaviour, statements, movement or identity of a real person.
(2) Such content may be particularly risky, because viewers may believe that the person actually took part in, said or did something.
Art. 33. (1) The User has no right to create or use synthetic content that imitates a real person for the purpose of fraud, deception, blackmail, damage to reputation, harassment, political manipulation, sexual humiliation, defamation or other harm.
(2) When using the image, voice or other recognisable characteristics of a real person, the User is responsible for having the necessary consent, right or legal basis.
Art. 34. (1) Content featuring public figures, politicians, journalists, doctors, lawyers, teachers, well-known artists or other recognisable persons should be used with increased care.
(2) The User must not create the impression that such a person has made a statement, endorsed a product, taken part in an event, performed an action or approved content if this is not true.
Art. 35. (1) Using the platform does not release the User from the obligation to observe copyright, related rights, trademark rights, design rights, image rights, property rights, contractual restrictions and other third-party rights.
(2) The User is responsible for all input files they use, as well as for the way in which they use the results obtained.
Art. 36. (1) The Provider does not guarantee that the result is unique, protectable as a copyright work, free of similarity to other works or suitable for registration as a trademark, design or other protected object.
(2) The User should carry out the necessary checks before commercial use, sale, licensing, publication, printing, advertising or delivery to a client.
Art. 37. (1) If a platform for selling or licensing content, a client or a third party requires the labelling of content created by artificial intelligence, declarations of consent, permissions to use a person's image, permissions to use property, proof of copyright or other documentation, the User is responsible for providing it.
Art. 38. (1) The User may use the results for personal or commercial purposes only to the extent permitted by law, by the rules of the platform, by the terms of the respective model and by third-party rights.
(2) The Provider does not guarantee that a given result will be accepted by a client, an editor, an advertising network, a social network, a print publication, a platform for selling or licensing content, a public authority or another third party.
Art. 39. (1) For professional use, the User should additionally check:
1. The rights to the input files;
2. The rights to elements in the result;
3. The presence of real persons, buildings, brands, works or other protected objects;
4. The need to label the content as created by artificial intelligence;
5. The technical quality;
6. Compliance with the requirements of the client or the platform;
7. Compliance with the applicable law.
Art. 40. (1) genkiki.com may use external providers of models, technical processing, storage, computing services, payment services and other support services.
(2) When a given service is used, the instructions, files, settings and technical data provided by the User may be sent to such an external provider in order to fulfil the request.
Art. 41. (1) External providers may impose their own restrictions, including:
1. Prohibited types of content;
2. Restrictions on images of people;
3. Restrictions concerning minors;
4. Restrictions on violence, sexual content, political content or sensitive topics;
5. Restrictions on the size, duration, resolution or format of the files;
6. Restrictions on the number of results;
7. Restrictions on the processing speed;
8. Restrictions on commercial use;
9. Technical filters;
10. Other rules and restrictions.
Art. 42. (1) An external provider may refuse a request, return an error, delay processing, change the behaviour of a model or stop access to a given feature for reasons beyond the Provider's control.
(2) In such a situation genkiki.com may release or refund credits in accordance with its rules, where the service has not been performed and where the reason is not a breach on the part of the User.
Art. 43. (1) Artificial intelligence models may be changed, updated, temporarily suspended, replaced or removed.
(2) For this reason, results obtained at different moments may differ, even when the User uses similar instructions.
Art. 44. (1) The Provider may change the available models, their names, description, price in credits, settings, permitted files, output formats, limitations, storage periods and other characteristics.
(2) Such changes may be necessary because of technical development, a change in the terms of an external provider, legal requirements, security, quality, costs or the development of the service.
Art. 45. (1) The use of certain models may require credits.
(2) The price in credits may depend on the model chosen, the type of service, the duration, the resolution, the number of results, the settings, the file size and other technical parameters.
Art. 46. (1) Where the generation has been technically performed and a result has been returned, the credits may be deducted even if the User does not like the result for aesthetic, creative or subjective reasons.
(2) It is not considered a technical error merely that the result:
1. Does not fully match expectations;
2. Has a different style;
3. Contains inaccuracies typical of artificial intelligence;
4. Is not suitable for a particular commercial purpose;
5. Has not been accepted by a third-party platform;
6. Requires additional processing;
7. Does not fully follow all the instructions.
Art. 47. (1) If the generation has not been performed because of a technical error, unavailability of a model, an interruption of the processing or another problem that is not due to a breach on the part of the User, the platform may release or refund the reserved credits.
Art. 48. (1) The platform may store generated results, input files, history, settings and related data for a certain period.
(2) The period may depend on the type of user profile, the chosen plan, the technical limitations, the storage rules, the available space and other conditions.
Art. 49. (1) The User is responsible for downloading and saving the results that are important to them in good time.
(2) The Provider does not guarantee indefinite storage of results unless this is expressly provided for in a particular plan or agreed in writing.
Art. 50. (1) If the platform provides a public gallery, a content feed, a page with examples, a public profile, a shared link or another public feature, the User is responsible for the content they publish or share.
(2) The User must not publish content that infringes the law, the rights of others, private life, reputation, this document, the Terms and Conditions or the Rules on permitted content and AI generations.
Art. 51. (1) When sharing publicly, the User should assess whether it is necessary to indicate that the content has been created or modified by artificial intelligence.
(2) The Provider may remove, hide, restrict or label public content if it considers this necessary to protect users, third parties or the platform, or to comply with legal requirements.
Art. 52. (1) Content involving minors or persons who appear to be minors is treated with increased care.
(2) The User has no right to create, process, publish or distribute content that sexualises, exploits, humiliates, endangers, misleads or harms minors.
Art. 53. (1) When using images, video or the voice of a minor, the User must have the necessary right, consent or legal basis.
(2) The Provider may block or remove content where there is a risk to minors or a suspicion of a breach.
Art. 54. (1) The User should not enter into the instructions or upload files containing personal data of third parties unless they have a legal basis for doing so.
(2) Particular care should be taken with data such as names, addresses, phone numbers, identity documents, faces, voices, health information, financial data, data about children, private correspondence and other sensitive information.

Art. 57. (1) The User has no right to remove or conceal a label indicating that a given piece of content has been created by artificial intelligence, where such a label is required by law, by contract, by the rules of a third-party platform or because of a risk of misleading anyone.
Art. 58. (1) Before using a result, the User should check:
