(8) In the event of a technical error, a failed generation or a refusal by an external model, the Provider may restore reserved or deducted credits where the system data show that the service was not performed.

(5) The Provider is entitled to change the credit price of the models because of changes in costs, in the terms of the external providers, technical changes, market conditions or the development of the service.
(6) Price changes do not affect generations that have already been completed.
Art. 10. (1) When a paid AI generation is started, the platform may first reserve the credits required.
(2) Once the generation has been performed successfully, the reserved credits may be deducted definitively.
(3) If the generation is not performed because of a technical error, unavailability of an external model, a system error or another reason not caused by a breach on the part of the User, the reserved credits may be released or restored.
(4) If the generation is refused because of a breach of the content rules, a prohibited prompt, a prohibited file, abuse, an attempt to circumvent filters or a breach of the rules of an AI model, the Provider may decline to restore credits where the cost has already been incurred or the request has already been processed by an external provider.
(5) If a generation is only partly performed, the Provider may deduct a proportionate share of the credits or apply other logic indicated on the platform.

(6) The User may cancel automatic renewal in the manner indicated in the account or in these Terms and Conditions.
(7) When switching from a higher to a lower plan, the change may take effect:
1. immediately;
2. at the end of the current paid period;
3. in accordance with the terms shown at the time of the switch.

(6) If the Provider is registered for VAT or VAT has to be charged, the tax is charged in accordance with applicable law.
(7) The User is responsible for all fees, commissions, currency differences or bank charges applied by their bank, card issuer or payment operator.
(8) In the event of a failed payment, a cancelled payment, a disputed payment, a contested transaction or a suspicion of fraud, the Provider may suspend access to paid services, withdraw credits already added, block the account or take other reasonable measures.
Art. 14. (1) Where applicable, the Provider issues an invoice or another accounting document based on the details provided by the User.
(2) The User is responsible for the accuracy of the invoicing details provided.
(3) If the User wants an invoice made out to a company, they must provide the necessary company details before or during the purchase, where the system allows this.
(4) Corrections to documents already issued may be refused if they conflict with applicable accounting or tax law.
Art. 15. (1) Users who qualify as consumers within the meaning of applicable law may have the right to withdraw from a distance contract within the statutory period, except in the cases where the law allows exceptions.
(2) The platform provides digital services and/or digital content, the performance of which may begin immediately after the User's request.
(3) Where the User expressly requests that performance of a paid digital service begin immediately, for example an AI generation, file processing or the use of credits, and confirms that they understand that once the service has begun or has been fully performed they may lose their right of withdrawal for the part already performed, the amounts and credits for services already begun or performed are not refundable, unless the law provides otherwise.
(4) An AI generation is deemed to have begun when the User confirms the request and the system starts processing, reserves credits, sends a request to an AI model or an external provider, or starts internal processing.
(5) An AI generation is deemed to have been performed when the system returns a result, file, image, video, audio, text, processed file, completed-task status or another output.
(6) Paid credits that have already been used are not refunded solely because of:
1. subjective dissatisfaction with the result;
2. a style different from the one expected;

4. inaccuracy in details;
5. a lack of commercial fitness for a particular purpose;
6. withdrawal by the User after the start;
7. an incorrectly entered prompt;
8. an unsuitable file uploaded;
9. incorrectly chosen parameters;
10. failure to meet the requirements of third-party platforms, for example stock sites or social networks.
(7) A refund of credits or of amounts may be made at the Provider's discretion or where the law so requires, for example in the event of:
1. a technical error of the platform;
2. a duplicate payment;
3. a service not received because of a system problem;
4. an inability to perform for which the Provider is at fault;
5. another justified reason.
(8) For subscription plans, cancelling automatic renewal does not always lead to a refund of the amount already paid for the current period, unless the law or the specific terms provide otherwise.
(9) Promotional, bonus, test or free credits are not subject to a cash refund.
Art. 16. (1) genkiki.com may use external AI models, API services, cloud services and other technical providers.
(2) When using a given AI feature, the User understands and accepts that the input content, the prompts, the uploaded files, the technical parameters and other necessary information may be sent to an external provider in order to carry out the request.
(3) The Provider does not have full control over the way each external AI model interprets prompts, generates results, refuses requests, applies filters, sets technical limitations or changes its own terms.
(4) External providers may change at any time:

(5) The Provider is not liable for the temporary or permanent unavailability of an external model where the cause is beyond its reasonable control.
(6) The Provider may replace a given model with another one, remove it or restrict access to it where this is technically, legally, commercially or contractually necessary.
Art. 17. (1) The User understands and accepts that AI models work probabilistically and that the results may be unpredictable.

(5) The User should not rely on an AI result as the sole source for legal, medical, financial, technical, professional, educational, news-related or other important decisions.
Art. 18. (1) Content created through genkiki.com may be wholly or partly generated, edited, transformed or enhanced by artificial intelligence.
(2) The User understands that in certain cases the law, platform rules, advertising standards, professional rules or the context of publication may require the content to be labelled as AI-generated, AI-modified or synthetic.

(6) The User may not remove, conceal or circumvent labels, watermarks, metadata or other markers where their presence is required by law or by the rules of the platform.
Art. 19. (1) The User retains all their rights in the input content they upload or enter on the platform, to the extent that they hold such rights.
(2) By uploading or entering input content, the User declares and warrants that:

3. they have the right to submit it for AI processing;
4. the content does not infringe third-party rights;
5. the content does not contain unlawful material;
6. the content does not contain personal data of third parties without a legal basis;
7. the content does not infringe copyright, related rights, trade marks, personality rights, image rights, voice rights, the right to privacy or other rights.
(3) The User grants the Provider a non-exclusive, limited, royalty-free and technically necessary right to store, copy, process, transmit, convert, display and use the input content solely to the extent necessary to provide the requested service, for support, security, evidence of operations, prevention of abuse and compliance with legal obligations.
(4) The right under paragraph (3) does not mean that the Provider acquires ownership of the input content.
Art. 20. (1) The Provider claims no ownership of the generated content created through the User's account, unless expressly agreed otherwise.
(2) The User may use the generated content in accordance with:
1. these Terms and Conditions;

(5) Where the User uses input content that contains other parties' works, people, brands, designs, logos, products, architecture, voices, likenesses or other protected elements, they are responsible for obtaining the necessary rights and permissions.
(6) USER RIGHTS. The User retains their rights in the generated content and may use it freely, including for commercial purposes, and may also pass those rights on to their own clients and to third parties. These rights are retained even after the subscription or the account is terminated, in respect of content that has already been downloaded.
(7) LICENCE FOR THE OPERATION OF THE SERVICE. So that the service can work, the User grants the Provider a non-exclusive, worldwide, royalty-free licence to store, reproduce, process, adapt and display the content, with the right to sub-license it to the Provider's service providers and technology partners, to the extent necessary for providing, maintaining and developing the service. The licence is non-exclusive and does not restrict the User.
(8) DEVELOPMENT OF THE MODELS. The User accepts that the content, the descriptions and the results may be used by the Provider and by its technology partners for training, evaluating, developing and improving the models, the filters and the related services. This use ceases going forward once the content concerned or the account is deleted.

(2) The Provider does not warrant that AI results will be accepted by stock platforms, advertising networks, social networks, publishers, clients, institutions, competitions, media or other third parties.
(3) The User is responsible for checking whether the generated content meets the requirements of the platform or client for which they are using it.
(4) If a platform for selling or licensing content, a client or a third party requires AI content to be labelled, or requires consent declarations, permissions to use a person's likeness, property releases, proof of copyright or other documentation, the User is responsible for providing it.
(5) genkiki.com gives no legal, licensing or copyright guarantee that content will be accepted by third-party platforms.
Art. 22. (1) The User may not use the platform to create, process or distribute content that imitates, manipulates or depicts a real person in a way that:

(6) Where an account is terminated, a plan expires, a breach occurs, there is technical necessity or a period expires, the content may be deleted or restricted.
Art. 26. (1) The Provider applies an automatic policy for storing and deleting uploaded and generated files and media. Once the applicable period has elapsed, files are deleted automatically for reasons of security, personal data protection and disk space management.
(2) The specific periods depend on the type of file and on the User's subscription plan and reflect the platform's current settings. At present they are as follows:
Depending on the subscription plan, these periods are extended:
Grace period before permanent deletion: 2 days.
Notice before automatic deletion: 3 days in advance.
(3) Before being deleted for good, files may go through a short grace period during which they are marked for deletion but, where technically possible, can still be restored. Where this feature is active, the Provider sends advance notice before the automatic deletion so that the User can download the files that matter to them.
(4) Failed, interrupted or cancelled generations and the files associated with them are stored for a shorter period than successfully completed results.
(5) The User is responsible for downloading and saving the results that matter to them before the applicable period expires. The Provider is not liable for files deleted in accordance with this policy.
(6) The Provider may change the storage periods at any time through the platform settings. This section always reflects the site's current configuration.
Art. 27. (1) By default the User's content may be private, unless a public sharing feature has been selected or activated on the platform — a content feed, gallery, profile, link, showcase section, community or another public feature.
(2) If the User publishes, shares or makes content public, they grant the Provider the right to render, host, display, format, optimise, cache and distribute it within the platform and its related public features.
(3) The User is responsible for ensuring that public content does not breach the law, third-party rights or these Terms and Conditions.
(4) The Provider may remove or hide public content following a report, a breach, a risk, for a technical reason or at its own discretion.
(5) If the platform offers a public gallery, feed or community functionality, the Provider may apply additional rules on visibility, ranking, moderation, reporting, comments, likes or sharing.
Art. 28. (1) Anyone may submit a report about content they consider to be unlawful, to infringe rights or to be contrary to these Terms and Conditions.
(2) A report may be submitted by email to: [email protected] or through a dedicated form, if one is available.
(3) The report should contain, as far as possible:
1. a description of the content;
2. a link, ID, screenshot or another means of identifying it;
3. the reason for the report;
4. the legal or factual grounds;
5. contact details of the person submitting it;
6. a statement that the information is true to the best of the submitter's knowledge.
(4) The Provider reviews reports in good faith and may take measures, including:
1. removing content;
2. restricting visibility;
3. blocking a generation;
4. issuing a warning;
5. temporarily restricting an account;
6. terminating an account;
7. refusing to act if the report is unfounded;
8. notifying the competent authorities where the law requires this.
(5) Where applicable, the User affected may receive information about the measure taken and an opportunity to file an objection.
Art. 29. (1) If the User disagrees with a decision to remove, restrict, block or refuse content, or to restrict an account, they may file an objection by email to: [email protected].
(2) The objection should contain:
1. the account details;
2. a description of the content or decision concerned;
3. the reason why the User considers the decision to be wrong;
4. any additional evidence or explanations.
(3) The Provider reviews objections within a reasonable time.
(4) Filing an objection does not guarantee that content, credits, an account or access will be restored.
(5) The Provider may refuse to review manifestly unfounded, repetitive, abusive or bad-faith complaints.
Art. 30. (1) The User undertakes:
1. to use the platform only for lawful purposes;
2. to comply with these Terms and Conditions;
3. to provide true information;
4. to keep their login details safe;
5. not to infringe third-party rights;
6. not to upload unlawful content;

13. not to copy, scrape data automatically or extract content systematically;
14. to comply with the rules of the external AI models;
15. to label AI content where this is required;
16. to check the results before using them;
17. to take responsibility for the commercial and public use of the results.
Art. 31. (1) The Provider undertakes to make reasonable efforts to ensure:
1. access to the platform;
2. the maintenance of the core functionality;

4. the protection of user data;
5. the correct crediting and deduction of credits;
6. the processing of payments through reliable providers;
7. the review of reports and complaints;
8. notification of material changes where necessary;
9. compliance with applicable law.
(2) The Provider does not guarantee that the platform will work without interruption, without errors, without delay or without incompatibility with devices, browsers, files or external services.
Art. 32. (1) The Provider is not liable for:
1. subjective dissatisfaction with an AI result;
2. inaccuracies, errors or artefacts in generated content;
3. damage caused by improper use of a result;
4. the use of content in breach of the law or of third-party rights;
5. refusal by stock platforms, clients or third parties to accept content;
6. acts or omissions of external AI providers;
7. temporary unavailability of models;
8. changes to the rules or prices of external providers;
9. loss of files if the User has not downloaded them in time;
10. data entered incorrectly by the User;
11. unauthorised access due to a weak password or the User's negligence;
12. damage caused by force majeure;
13. loss of profit, lost revenue, lost clients, reputational harm or indirect damage, unless the law provides otherwise.
(2) Nothing in these Terms and Conditions excludes or limits liability that cannot be excluded or limited under applicable law.
Art. 33. (1) The Provider may temporarily suspend access to the platform or to individual features for:
1. technical maintenance;
2. updates;
3. bug fixing;
4. improvements;
5. security;
6. changes to models;
7. migration;
8. protection against attacks;
9. other technical reasons.
(2) The Provider may carry out planned or unplanned maintenance.
(3) Where possible, the Provider may notify Users of significant interruptions, but is not obliged to give advance notice of every technical intervention.
Art. 34. (1) The platform may offer beta, experimental, preview, test or early access features.
(2) Such features may be unstable, inaccurate, limited, temporary, slow, variable or unavailable.
(3) The Provider may change, suspend or remove a beta feature at any time without notice.
(4) The User uses beta features at their own risk.
Art. 35. (1) Personal data is processed in accordance with the genkiki.com Privacy Policy.
(2) The Privacy Policy describes what data is collected, for what purposes it is used, on what legal basis, how long it is kept, with whom it is shared and what rights the User has.
(3) By accepting these Terms and Conditions, the User confirms that they have been informed of the existence of a Privacy Policy.
Art. 36. (1) The platform uses cookies and similar technologies in accordance with the Cookie Policy.
(2) Strictly necessary cookies are used for the operation of the site, security, account login, sessions, payments and core functionality.
(3) Optional cookies, such as analytics, marketing or tracking cookies, are used in line with the User's choice and consent, where consent is required.
Art. 37. (1) The User may not:
1. attempt unauthorised access;
2. test for vulnerabilities without permission;
3. carry out DDoS or other attacks;
4. use malicious scripts;
5. circumvent limits;
6. manipulate the credit system;
7. use fake accounts for abuse;
8. create mass registrations;
9. use stolen payment details;
10. harvest data by automated data extraction;
11. disrupt the operation of the platform.
(2) Where abuse is suspected, the Provider may restrict an account, a payment, an IP address, a device, an access method or other technical parameters.
(3) The Provider may keep technical logs and security data in order to prevent abuse and protect the platform.
Art. 38. (1) The User may request the closure of their account through the platform settings, or by email to the Provider if that option is not available.
(2) Before closing the account, the User should download the files and results that matter to them.
(3) Closing the account may result in the loss of access to:
1. history;
2. files;
3. generated results;
4. credits;
5. subscription features;
6. settings;
7. invoicing history, where storage is not required by law.
(4) Closing an account does not release the User from obligations that arose before the closure.
(5) The Provider may retain certain data after closure where this is necessary for accounting, legal, tax, defence or evidential purposes, or for security.
Art. 39. (1) The Provider may temporarily or permanently restrict, suspend or terminate an account in the event of:
1. a breach of the Terms and Conditions;
2. unlawful content;
3. abuse of credits;
4. attempted fraud;
5. a chargeback or a disputed payment;
6. infringement of third-party rights;
7. an attack against the platform;
8. automated abuse;
9. circumvention of technical restrictions;
10. a breach of the rules of AI models;
11. danger to other users;
12. a legal obligation;
13. a material risk to the Provider.
(2) Where an account is terminated for a breach, the Provider may refuse to refund unused credits, bonuses or access, to the extent permitted by law.
Art. 40. (1) The Provider may offer promotions, bonus credits, discounts, affiliate programmes, referral programmes, reselling terms or other commercial campaigns.
(2) Each promotion may have its own terms, duration, limits, eligible users, minimum requirements and restrictions.
(3) Promotional credits may have a validity period and may be withdrawn in the event of abuse.
(4) The Provider may end, change or refuse a promotion in the event of abuse, a technical error, fake registrations, registration or purchase through one's own referral link, fraud or a breach.
(5) Affiliate rewards may be withheld, cancelled or adjusted in the event of cancelled payments, chargebacks, fraud, a breach or suspicious activity.
(6) PARTICIPATION. The affiliate programme lets the User recommend the Platform and receive cash remuneration in euro and/or bonus credits for doing so. Participation is free and requires no initial investment. Participation begins when the affiliate programme is activated for the User's profile and they confirm that they are familiar with the terms of this section. For particular specialised programmes and campaigns, the Provider may introduce additional requirements or prior approval.
(7) By activating it, the person declares that they are 18 years of age or older and have the necessary legal capacity. The Provider is entitled to request proof and to refuse or suspend payment if the declaration proves to be untrue.
(8) Participation does not create an employment relationship, commercial agency, partnership, company or franchise between the parties. The affiliate acts in their own name and on their own account, may not present themselves as an employee, official representative or authorised person of the Provider, and may not enter into obligations on the Provider's behalf.
(9) The Provider runs a separate affiliate programme for each of its sites. The same affiliate code is valid for all of them. Which programme applies to a given referral is determined by the visit data recorded by the Provider's system at the moment the referral arises; in the event of a dispute, the Provider's records are decisive. The applicable terms are those of the programme concerned, unless tier terms or individual terms under paragraph 31 have been set for the affiliate.
(10) RECOGNITION OF THE REFERRAL. When someone visits through an affiliate link, a cookie holding the affiliate code is stored on the visitor's device with a lifetime of 180 days. The referral is recognised if the visitor registers while that cookie is still active in their browser.
(11) If the visitor passes through the links of more than one affiliate, the link recognised is the last one whose visit was successfully recorded. If a visit is rejected by the safeguards under paragraph 13, the link to the previous affiliate is retained.
(12) Besides through an affiliate link, a referral also arises when a user who does not yet have an affiliate uses an affiliate's promo code when making a purchase. In this case recognition takes place at the moment of purchase and does not depend on a cookie. Each user can be linked to only one affiliate; the link is fixed when the referral arises and can be corrected only in the event of a proven technical error or abuse, and the affiliate concerned is notified.
(13) A referral is not recognised where: the registration was made by the affiliate themselves or through their own link; the cookie has been deleted or blocked, or the registration was made on another device or in another browser; the code is invalid, deactivated or deleted; the visit was made by an automated tool, bot or indexing software; or one of the anti-abuse safeguards has been triggered, including the limit on the number of registrations from a single network or device.
(14) The affiliate may create named campaigns and codes with a QR code in order to track results by channel. The figures in the affiliate dashboard are for information only; in the event of a discrepancy, the Provider's records are decisive.
(15) The author's affiliate code may be added automatically to the public pages of the works they have published, so that visits through those pages are also counted as referrals.
(16) Tracking is carried out through a cookie and technical data about the visit. The processing of this data is described in the Privacy Policy and in the Cookie Policy. The current periods are also published in the affiliate dashboard; a change of period applies only to future visits and does not affect referrals already recognised.
(17) TYPES OF REMUNERATION. The programme provides two separate types of remuneration: a cash commission in euro and bonus credits for using the Platform. The two are accounted for separately and are not converted into one another.
(18) CASH COMMISSION. The affiliate receives a percentage of every payment made by a user they referred — for a subscription, for a subscription renewal and for a credit pack. The commission is not limited to the first purchase and accrues for with no time limit, counted from the registration of the referred user. The percentage is not the same for all affiliates: the programme is tiered and the affiliate climbs through the tiers according to the results they achieve.
Current levels and commissions:
(19) For individual affiliates the Provider may agree bespoke terms, including a different percentage, different periods and additional privileges. Where such terms are agreed, they take precedence over the general terms of the tier and of the programme.
(20) Which affiliate receives the commission for a given payment is determined by the link under paragraphs 10–12 — by the last successfully recorded visit through an affiliate link, and for a purchase made with another affiliate's promo code, by the owner of that code. The percentage applied is the one in force for that affiliate at the time of the payment; a subsequent change of tier or of terms does not affect commissions already accrued.
(21) The percentage is calculated on the amount actually paid for the order, after deduction of any discounts and promo codes applied. The remuneration is accounted for in euro; a payment in another currency is converted into euro at the rate applied by the Provider at the time of the payment.
(22) Commission is payable only for users referred directly by the affiliate. The programme has no multi-level structure and no remuneration is payable for referrals made by referred persons.
(23) BONUS CREDITS. The programme may award bonus credits on certain events. Which events are active and how large the award is are announced in the affiliate dashboard and in the description of the programme concerned, and may be changed going forward without this affecting credits already awarded.
(24) A newly registered user who arrives through an affiliate invitation receives a starting bonus of the amount announced at the time of registration. This bonus goes to the new user, not to the affiliate, and can be combined with the Platform's general welcome bonus. The bonus is credited if the registration is successfully linked to an invitation and passes the automatic anti-abuse checks.
(25) Credits are an internal accounting unit for using the services. They are not money, have no monetary value outside the Platform, are not exchanged for money and are not paid out. Credits under the programme may have a validity period — for referral credits it is 60 days — and follow the general regime for credits under these Terms and Conditions.
(26) CREDITS FOR SHARING. The affiliate may receive bonus credits for sharing their affiliate link — on social networks, in messaging apps and in their own channels (blog, forum, personal site), in accordance with the list of channels maintained on the Platform. The reward is 15 credits for a verified share.
(27) Posting alone does not create a right to credits. Credits are payable once the sharing has been successfully verified, which may be done in one of the following ways: (a) automatically — when a genuine visit comes through the shared link within 24 hours of the sharing being recorded; (b) by checking the content — when the affiliate submits the public address of the post and the system confirms that the affiliate link is present in it; (c) manually — after a review by the Provider. Unverified shares lapse after 30 days.
(28) The following limits apply: up to 300 credits from sharing within any 24 hours and up to 10 shares for a single platform within any 24 hours. The limits are calculated over a rolling period rather than by calendar days, and include all recorded shares, whether or not they have been verified.
(29) The post should remain publicly accessible. The Provider is entitled to carry out a follow-up check and, if it finds that the post is no longer accessible or no longer contains the affiliate link, the credits awarded for it may be deducted from the affiliate's balance after notice.
(30) PROMO CODES. The Provider may give the affiliate the right to create a personal promo code that gives a discount to the customer who enters it at payment. The size of the discount is set for each code and is shown next to the code itself. The affiliate may not use their own code.
(31) The code may be limited by a validity period, by a maximum total number of uses and by a maximum number of uses per user; the specific limits are shown next to the code itself in the affiliate dashboard. Only one promo code may be applied to a single order, and the discount is calculated on the amount due after the promotions currently running for the pack concerned have been applied. The code's overall limit is counted when the payment is started, whether or not it is completed successfully; the Provider may, at its discretion, restore a used-up limit for payments that were not completed.
(32) TIERS. Moving up to a higher tier may happen automatically once an announced threshold is reached, or after an application and approval by the Provider, who assesses applications at its own discretion. The Provider may change the tiers, the thresholds and the conditions attached to them going forward.
(33) HOLDING AND CONFIRMATION. The commission accrued enters a “pending” state and is held for 30 days from the payment made by the referred customer. The holding period serves as protection in the event of withdrawal from the contract, a refund or a disputed payment. Once the period has elapsed, and if there is no ground for cancellation, the commission is confirmed and becomes ready for payout.
(34) PAYOUT. The affiliate does not have to submit a request — the payout is automatic. Every month, between the 1st and the 15th, the Provider pays out the confirmed amount accumulated up to the end of the previous calendar month, provided it has reached the minimum threshold of 15 € and the affiliate has submitted correct payment details.
(35) If the minimum threshold is not reached, the amount is not lost — it stays in the affiliate balance and is carried over to the next payout period until the threshold is reached. While payment details are missing or incorrect, the amount is kept in the balance with no time limit.
(36) Payouts are made by bank transfer to the details the affiliate has entered in their profile. The Provider may also introduce other payout methods; these become available once they are announced in the affiliate dashboard. The affiliate is responsible for the accuracy and currency of the details.
(37) The Provider may refuse or postpone a payout where there is a reasonable suspicion of abuse — until the check has been completed.
(38) CANCELLATION AND RECOVERY. In the event of withdrawal from the contract, a refund, a chargeback or a disputed payment, the commission concerned is cancelled. If it has already been paid out by then, the affiliate must return the amount received; the Provider is entitled to set it off against future remuneration under the programme.
(39) The confirmed cash balance does not expire with the passage of time, except under the statute of limitations provided by law.
(40) PROHIBITED ACTIONS. While taking part in the programme, the following are prohibited: registering or purchasing through one's own referral link, including through related persons or additional accounts of one's own; creating fake, duplicate or automatically generated accounts; using bots, scripts, automated tools or paid services to generate visits, registrations or posts artificially; sending unsolicited messages and any form of spam; misleading, false or aggressive advertising, including promises of income, results or terms that the Provider does not offer.
(41) The following are also prohibited: presenting oneself as an employee, official representative or exclusive partner; using the Provider's name, brands, logos and copyrighted content outside the advertising materials supplied or without the Provider's consent; registering domains, profiles, pages and apps that contain or resemble the Provider's brands; buying advertising on the Provider's brand terms in search engines and ad networks; posting the affiliate link in unlawful content, in content unsuitable for the age of the audience, or in breach of the rules of the platform concerned.
(42) DISCLOSURE. The affiliate must disclose clearly and understandably the commercial nature of their messages and the existence of affiliate remuneration, in accordance with the requirements of applicable consumer protection law and the rules of the platform concerned.
(43) DATA ABOUT REFERRED USERS. In the affiliate dashboard the affiliate is given access to limited information about the users they have referred and about the stage those users have reached. The affiliate may not use this information for any other purpose, disclose it to third parties, cross-reference it with other sources or process it for their own marketing.
(44) PUBLICITY. The Provider may maintain a public affiliate leaderboard. The leaderboard is shown in anonymised form. An affiliate's name, pseudonym or other identifier is published only with their express consent.
(45) SANCTIONS. In the event of a breach of paragraphs 40–43 or a reasonable suspicion of abuse, the Provider may, individually or in combination: withhold payment until a check has been completed; cancel remuneration and credits that have accrued but not been paid out; end the affiliate's participation; restrict or terminate access to the account; and seek compensation for the damage suffered.
(46) CHANGES TO THE PROGRAMME TERMS. The current percentages, bonuses, thresholds, limits, tiers and periods are those published in the affiliate dashboard and on the programme page, and are reflected in this section. The Provider may change them, and the changes take effect going forward. Remuneration already accrued is not affected — it is calculated at the percentage in force on the date the referred customer paid. An increase in the minimum payout threshold does not apply to a balance that has already been confirmed; for that balance the threshold in force at the time of confirmation applies.
(47) ENDING PARTICIPATION. Either party may end participation in the programme at any time. The affiliate declares that they are ending it by written request to the Provider at the contact address given; the Provider ends participation by deactivating the affiliate profile, and notifies the affiliate.
(48) Where participation ends for a reason other than a breach, the accumulated confirmed cash balance is paid out within 60 days of the end, once the affiliate has submitted correct payment details; in that case the minimum threshold under paragraph 34 does not apply.
(49) Where participation ends because of a breach of paragraphs 40–43 or because of fraud, the Provider may refuse to pay out the unpaid remuneration connected with the breach, in proportion to its seriousness. The Provider notifies the affiliate in writing of the grounds; the affiliate may object within 14 days, and the Provider gives a reasoned decision.
(50) Closure of an account is requested in writing to the Provider. An affiliate account with remuneration that has accrued but not been paid out is closed once the payout has been completed; for this purpose the affiliate submits the necessary payment details. Bonus credits are not compensated in money when an account is closed.
(51) SUSPENSION OR TERMINATION OF THE PROGRAMME. The Provider may suspend the affiliate programme temporarily or terminate it altogether. In that case the Provider pays out the amounts already confirmed to the details given by the affiliate within 60 days of the suspension or termination, with no need for a request through the dashboard and without applying the minimum threshold; if payment details are missing, the affiliate submits them to the contact address given.
